Onnoghen Loses At Appeal Court, To Face CCT Trial

The Court of Appeal has dismissed a motion filed by the Chief Justice of Nigeria (CJN), Walter Onnoghen challenging his suspension.

This is even as the embattled legal luminary is seeking a stay of proceedings in his trial at the Code of Conduct Tribunal (CCT).

The court noted that, in view of the provision of Section 306 of the Administration of Criminal Justice Act (ACJA), it lacked the power to stay proceedings in criminal cases.

It also explained a court has inherent jurisdiction to grant a stay of proceedings where it is certified that enough evidence has been given for such.

It also said the charges filed against Onnoghen are criminal in nature and the proceedings before the CCT could not be stopped.

The court, thereafter, held that the stay of proceedings would not be granted.
